Authorities
These records are created, used, retained and managed in accordance with the following authorities:
- Freedom of Information and Protection of Privacy Act (RSBC 1996, c. 165)
- Employment Standards Act (RSBC 1996, c. 113)
Retention rationale
Records related to hiring non-academic staff should be retained for a period of 6 years after a competition is completed in the event of appeal, grievance and/or arbitration disputes. For example, individuals have one year from the competition end date to file a grievance with the BC Human Rights Commission, at which point it may take up to two years for the Human Rights Commission to contact Â鶹ÊÓƵand initiate an investigation. In addition, Employment and Social Development Canada requires that public bodies (including universities) keep copies of all documentation relating to the recruitment and hiring process for a period of 6 years following the start date of a foreign worker (i.e., a person hired who is a non-Canadian/non-Permanent Resident).
As per Human Resources procedures, at the conclusion of a competition, all records (physical and digital) relating to the competition are sent to the Human Resources Department and become part of the official competition file. Therefore, a total retention period of “employee start date + 6 years, followed by destruction for competition files managed by the Human Resource Department, and “year competition completed + 1 year, for copies of competition files retained by the hiring department, followed by destruction is sufficient to meet the administrative needs of the university.
Retention and filing guidelines
Human Resources arranges these files by bargaining unit and within this grouping by competition number. Records relating to the successful candidate should be incorporated into the employee’s personnel file. In the event that an unsuccessful candidate appeals under university grievance or arbitration procedures or to the Human Rights Commission the file is classified a grievance files. In this case, the file would follow the retention rules outlined in RRSDA 1997-057 Grievance Case Files.
